Local councilman arrested for driving under the influence

Pawleys Island is a popular destination for tourists and South Carolina residents alike, especially in the warmer months. The joys of being on vacation or taking some time away from their busy lives also lends itself to having a few alcoholic beverages or indulging in other substances. Law enforcement is vigilant over this possibility of people committing DUI and is constantly on the lookout for those who might be exhibiting behaviors that indicate driving under the influence. That can make it important to lodge a defense with help from a Pawleys Island South Carolina DUI defense attorney.

A city councilman from Conway was arrested on suspicion of driving under the influence. The man, 35, was placed under arrest at around 1 a.m. when a law enforcement officer allegedly witnessed the driver operating his vehicle left of center on the road. The officer made a traffic stop, gave the councilman a field sobriety test and made the arrest. The councilman reportedly refused a breath test. He was released later that morning. The councilman has tried to get back to the business of doing his job as a representative and proclaims his innocence.

While driving under the influence is a negative, the simple fact that a law enforcement officer made a stop, investigated and made an arrest does not automatically mean the person is guilty. Field sobriety tests could be called into question based on how they are conducted, the circumstances and numerous other issues. The officer needs to have a justification for making the traffic stop. Certain protocol must be followed. If they are not, the entire arrest can be nullified. Formulating a comprehensive legal defense is vital to the case.

This incident shows that no one - not even elected officials - are immune to facing arrest for allegations of driving under the influence. A conviction for drunk driving can lead to a driver's license suspension, fines and even jail. A strong defense can potentially avoid these scenarios. The councilman protests that he is innocent and is planning his defense. For anyone who is facing a similar situation, having a qualified drunk driving lawyer can be the key to a case.
